The following conditions apply to all sales made on the www.twistproduction.com website and shipped by Twist Production, a division de 9342-6146 Québec Inc. (Twist). When you place an order for a product or products, you accept the present conditions which represent a binding agreement. If you do not accept the conditions, do not place your order.
PRODUCT AVAILABILITY
All orders are shipped from our warehouse in Quebec City, products that we have in stock are normally shipped within 48 hours. Items that we do not keep in stock can be delivered within two or three weeks. Twist cannot be held liable for not respecting the said delivery delays.
When a product is no longer available for purchase, the customer receives a refund notice by email.
PRICE
Prices advertised on the www.Twistproduction.com website are in Canadian dollars and before any taxes are charged. The price is payable in full and in a single payment when the order is placed. All orders are payable in Canadian dollars. For all deliveries outside Canada, any applicable duties or local tax remain the responsiblity of the consignee. Purchase refunds for items that are not available are also made in Canadian dollars. Please note that currency exchange rates applied are those from the date of purchase or refund. Twist commits to refund the same amount in Canadian dollars than the amount charged for the item that is no longer available or returned but cannot in any case be held liable for any difference in the amount due to the customer's bank exchange rate.
RETURNING ITEMS
The items delivered by Twist are new and guaranteed to be free of defects, If it was to happen that a product was defective or was not what had been ordered, Twist commits to take the item back and provide a refund within 10 days from the date of delivery. We will send a courrier service to your place of residence to retrieve the item. A return fee equivalent to 20% of the value of the items returned will be charged. Twist reseves the right at all times to refuse a return.
COMMUNICATION
When shopping on the website or when you send emails, you are communicating directly with Twist. Hence, you accept that the information and documents be shared electronically between you and Twist and that this communication is equivalent to an original paper written contract.
OWNERSHIP OF CONTENT
You agree that the entire content of the website, including : text, graphs, images (of people, products and places), trademarks, logos, etc. are the exclusive property of Twist. You agree that you do not acquire any right of posession or use of this content by visting the website or by placing orders for products.
LIMITATION OF LIABILITY
Twist will not be liable for accidental or indirect damages in any circustances. Any responsibility that Twist may be liable for will be limited to the amount paid for the product by the customer. Limitations and exclusions only apply to the limits permitted by law.
WARRANTY
Twist is proud of the quality of the products it produces and markets. Each component is inspected at every manufacturing step. To confirm Twist’s total confidence in its products, the company guarantees the first purchaser the rotational molded components for a 5-year period and the other components for a 1-year period against any defect in material or manufacturing.
The only Twist liability and the only recourse of the purchaser under this warranty will be the obligation to replace or repair defective components. The warranty is valid for products used in normal domestic environments and do not cover failures resulting from commercial use, intentional damage, negligence, abusive use, modifications made to the product, an accident or maintenance not done in accordance to the directives stated in the user manual. To fully benefit from the service and coverage offered by the warranty, you must contact Twist. A written permission from Twist is mandatory before returning a defective product for inspection.
Any product found defective within the delays stated in the warranty will be repaired or replaced FOB Quebec City if it is sent to the plant with freight costs paid in advance. Twist reserves the right to credit or replace the product or component with new or upgraded parts. Under no circumstances would Twist accept any responsibility for indirect or fortuitous damages in relation thereto the sale and usage of its products. This denial will remain valid throughout the warranty and after it expires. The warranty provisions are in addition to the legal warranties and other rights and remedies pursuant to any legislation, without modifying them or excluding any part whatsoever.
